EFFECTIVE Version 1.0 LAST UPDATED April 25, 2026 GOVERNING LAW United States SCOPE EHS Platform 01About this agreement These Terms & Conditions (“Terms”) form a binding agreement between you and American Health & Safety (“AHS,” “we,” “us,” or “our”) governing your access to and use of the AHS training platform, including our website, course library, learning management system, and any related services (collectively, the “Platform”). By creating an account, purchasing a course, enrolling a learner, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform. If you are accepting these Terms on behalf of a company or organization, you represent that you have the authority to bind that entity, and “you” will refer to that entity throughout this agreement. 02Key definitions Throughout these Terms we use the following defined terms: Individual User — a person who purchases courses for their own use through our online store. Corporate Client — an organization that purchases seats or subscriptions to provide training to its employees. Client Manager — an individual designated by a Corporate Client to assign courses, monitor progress, and pull reports for their own organization’s learners only. Learner — any person enrolled in a course, whether an Individual User or an employee of a Corporate Client. Course Content — videos, SCORM packages, slides, narration, assessments, downloadable resources, and any other materials made available through the Platform. Live Session — instructor-led training delivered via Zoom or another video conferencing service. 03Eligibility You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or purchase courses. The Platform is designed for occupational safety training and is not intended for general consumer or child use. Corporate Clients are responsible for ensuring that learners they enroll meet the eligibility requirements of the courses assigned to them. 04Account types & access The Platform supports four primary roles, each with distinct permissions: Individual User — purchases and completes courses for personal use; sees only their own data. Learner (corporate) — completes courses assigned by a Client Manager; sees only their own assignments and transcripts. Client Manager — assigns courses, tracks completion, runs reports, and manages users within their own organization only; cannot access data belonging to other Corporate Clients or AHS internal records. AHS Administrator — manages the global Platform, course catalog, and cross-client reporting. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Account sharing is prohibited and may invalidate any certificates issued under that account. 05Corporate client accounts When you sign up as a Corporate Client, AHS provisions a dedicated workspace for your organization. The workspace includes seat-based or subscription access to selected courses, one or more Client Manager accounts, and segregated reporting visible only to your organization. Client Managers may create, edit, and deactivate user accounts within their workspace. Seat counts may be increased mid-term and pro-rated; reductions take effect at renewal. The Corporate Client is responsible for the conduct of its users, the accuracy of employee records, and ensuring training assignments comply with applicable laws and collective bargaining agreements. AHS will not disclose one Corporate Client’s data to another under any circumstances except where compelled by law. 06Individual purchases Individual Users may purchase courses directly through our WooCommerce-powered store. Upon successful payment, you will be automatically enrolled in the course(s) purchased and granted access for the period stated on the product page (typically 12 months from the date of purchase, unless otherwise noted). Bundles, subscriptions, and promotional pricing are governed by the specific terms displayed at checkout, which are incorporated into these Terms by reference. 07Course enrollment & access Course access is personal, non-transferable, and limited to the term you have paid for or been assigned. You may resume an in-progress course at any time during the access period, and your progress (including bookmarks, time spent, and quiz attempts) is automatically saved. AHS reserves the right to update, replace, or retire courses to keep content aligned with current OSHA, ANSI, NFPA, EPA, DOT, and other applicable standards. Where a course is materially revised mid-term, learners with active access will be migrated to the updated version at no additional cost. 08Live instructor-led sessions Certain courses include or are delivered as Live Sessions through Zoom integration. By joining a Live Session, you agree that: Sessions may be recorded for training, audit, and quality purposes; recordings may be made available to enrolled learners. Attendance, duration, and participation may be logged automatically and used to determine completion. You will conduct yourself professionally and not record, redistribute, or publicly post session content without our written consent. If you miss a Live Session, makeup options are subject to instructor availability and the policy stated on the course page. 09SCORM tracking & learner data The Platform uses Tin Canny and SCORM-compliant tracking to record detailed learning data, including time spent in each module, slide-level progress, quiz responses and scores, completion status, and certificate issuance. By using the Platform, you acknowledge and consent to this tracking, which is essential to the integrity of safety certifications. For Corporate Client learners: this data is shared with your employer’s Client Manager for the purpose of training oversight and audit compliance. This is not optional — it is the basis on which your employer is paying for your training. 10Certificates & compliance tracking Upon successful completion of a course — including passing any required assessment with the minimum score stated on the course page — AHS will issue a digital certificate bearing a unique verification ID, the learner’s name, the course title, the completion date, and the issuing standard where applicable. Certificates reflect course completion only; they do not constitute a professional license, OSHA card, or third-party accreditation unless explicitly stated. Compliance dashboards track certificate expiration dates and notify Client Managers and learners of upcoming renewals. AHS retains completion records for a minimum of seven (7) years to support customer audits, in line with common OSHA recordkeeping expectations. Fraudulent completion (including credential sharing, automation, or assessment circumvention) will result in revocation of certificates without refund. 11Pricing, payment & refunds All prices are stated in U.S. Dollars unless otherwise indicated and are exclusive of applicable taxes. Individual purchases are processed at checkout via our payment processor; Corporate Client subscriptions are billed per the terms of the order form or invoice. Refund policy: Individual Users may request a full refund within 7 days of purchase, provided no more than 25% of the course has been completed and no certificate has been issued. After that point, all sales are final. Corporate subscriptions are non-refundable once the term begins, except as required by applicable law or as expressly agreed in writing. Failure to pay may result in suspension of access and revocation of in-progress (uncertified) enrollments. 12Intellectual property The Platform, Course Content, brand assets, course architecture, assessments, and underlying software are owned by AHS or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, AHS grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for the purposes described in these Terms. You may not copy, reproduce, redistribute, sell, sublicense, publicly display, modify, reverse-engineer, or create derivative works from any part of the Platform or Course Content without our prior written permission. Use of Course Content to train artificial intelligence or machine learning models is expressly prohibited. 13Acceptable use You agree not to: Share login credentials or allow others to complete courses on your behalf. Automate, script, or otherwise circumvent assessments, time tracking, or completion mechanics. Scrape, mirror, or extract Course Content for any purpose other than personal study. Upload viruses, malicious code, or attempt to interfere with Platform security or availability. Use the Platform to harass, defame, or harm any other user. Misrepresent your identity, employment, or eligibility for any course. Violations may result in immediate suspension, certificate revocation, and forfeiture of fees paid. 14Third-party services The Platform integrates with third-party services including Zoom (live sessions), payment processors (purchase processing), and analytics providers. Your use of these services is also subject to their respective terms and privacy policies. AHS is not responsible for the availability, accuracy, or conduct of third-party services beyond our reasonable control. 15Disclaimers The Platform and Course Content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. Course Content is for educational purposes and is not a substitute for site-specific safety procedures, qualified supervision, professional engineering judgment, or competent legal advice. Compliance with OSHA and other regulatory standards in your workplace is your responsibility, not ours. 16Limitation of liability To the maximum extent permitted by applicable law, AHS, its affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost data, business interruption, or workplace incidents arising from or related to your use of the Platform. Our aggregate liability for any claim arising out of these Terms or your use of the Platform will not exceed the amount you paid to AHS in the twelve (12) months immediately preceding the event giving rise to the claim. 17Indemnification You agree to indemnify, defend, and hold harmless AHS and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) for Corporate Clients, the conduct of your users on the Platform. 18Suspension & termination AHS may suspend or terminate your account for material breach of these Terms, non-payment, fraudulent activity, or any conduct that endangers other users or the integrity of certifications. Where practical, we will provide notice and an opportunity to cure. You may terminate your account at any time by contacting us. Upon termination, you will lose access to in-progress courses, but completion records and certificates already issued will remain on file for the audit retention period and may be exported on written request. 19Governing law & dispute resolution These Terms are governed by the laws of the State of [Insert State], United States, without regard to conflict-of-laws principles. Before initiating any formal proceeding, the parties agree to attempt to resolve disputes in good faith for at least thirty (30) days. Unresolved disputes will be submitted to binding arbitration in [Insert City, State] under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property infringement. For Individual Users, AHS is the data controller of your personal information. For Corporate Client learners, your employer is typically the data controller and AHS acts as the data processor on their instructions. 02Information we collect We collect the following categories of information: Account information — name, work email, phone, role, employer, language, and time zone. Authentication data — hashed passwords, login timestamps, and session tokens. Learning data — courses started, time spent in each module, slide-level progress, quiz responses, scores, completion status, and certificate IDs (collected via SCORM and Tin Canny). Purchase data — billing name, billing address, order history, and the last four digits of the payment card. Full card numbers are handled by our PCI-compliant payment processor and never stored on our servers. Device & technical data — IP address, browser type, operating system, device identifiers, and approximate location derived from IP. Communications — support tickets, emails to our team, and survey responses. Live session data — Zoom attendance, duration, chat messages, and recordings (where applicable). We do not collect biometric data, social security numbers, financial account numbers (beyond payment processing), or content from your camera or microphone outside of explicitly consented Live Sessions. 03How we use your information Deliver courses, score assessments, and issue certificates. Generate audit-ready completion records for Corporate Clients. Provide customer support and respond to inquiries. Process payments and prevent fraud. Improve content quality, course design, and platform performance. Send service-related notifications (course assignments, expiring certificates, account changes). Send marketing communications, only with your consent or where permitted by law (you can opt out anytime). Comply with legal obligations and respond to lawful requests from authorities. We do not sell your personal information. We do not share it with third parties for their independent marketing purposes. 04Legal bases for processing Where data protection law requires a legal basis, we rely on: Contract performance — to deliver the courses and services you or your employer purchased. Legitimate interests — to secure the platform, prevent fraud, and improve our services. Legal obligation — to comply with tax, accounting, and recordkeeping requirements. Consent — for optional analytics, marketing, and non-essential cookies (you may withdraw consent at any time). 05Corporate client data segregation The platform is built so that each Corporate Client operates inside an isolated workspace. Client Managers can only see and report on learners belonging to their own organization. AHS Administrators may access cross-client data internally to operate, secure, and improve the platform, but will not disclose one Corporate Client’s data to another except where compelled by law. Where AHS acts as a processor for a Corporate Client, processing is governed by the underlying service agreement and any applicable Data Processing Addendum (DPA). Corporate Clients can request a signed DPA at any time. 06SCORM & learner activity tracking The platform records detailed learner activity using SCORM 1.2 / 2004 packages and the Tin Canny xAPI layer, including: time on each slide, quiz attempts and answers, pass/fail outcomes, bookmarks, and completion timestamps. This level of tracking is necessary to verify that training was actually completed — a core requirement of OSHA recordkeeping and customer audit obligations. Learners enrolled by an employer should expect this data to be visible to their Client Manager and to AHS staff supporting the account. 07Payment information WooCommerce-powered purchases are processed by PCI-compliant payment processors (such as Stripe or PayPal). AHS receives confirmation of payment and limited card metadata (brand, last four digits, expiration), but never receives or stores full card numbers, CVV codes, or full bank account details. 08Zoom & live instructor-led sessions When you attend a Live Session through our Zoom integration, Zoom and AHS will process: your name, email, IP address, attendance and duration, in-meeting chat (where enabled), camera and microphone feed (only while you transmit), and recordings (where the session is recorded). Recordings are used for audit verification, makeup access for absent learners, and quality improvement. Zoom acts as a sub-processor and is bound by its own privacy commitments. 09Who we share information with Your employer — for Corporate Client learners, completion data flows to your designated Client Manager. Service providers / sub-processors — hosting (cloud infrastructure), email delivery, payment processing, analytics, video conferencing (Zoom), and customer support tools, all under written agreements. Auditors and regulators — where required to verify a certificate’s authenticity or to respond to lawful regulatory requests (e.g., OSHA inquiries). Legal authorities — where compelled by subpoena, court order, or applicable law. Successors — in connection with a merger, acquisition, or sale of all or part of our business, subject to equivalent privacy protections. 10Cookies & similar technologies We use cookies and similar technologies for the following purposes: Strictly necessary — to keep you signed in, remember your course progress, and operate the cart and checkout. These cannot be disabled. Functional — to remember preferences such as language and time zone. Analytics — to understand aggregate platform usage and improve performance. Off by default in regions that require consent. Marketing — used sparingly, only with consent, to measure campaign effectiveness. You can review and update your cookie choices at any time from the cookie panel in your account settings. 11How long we keep your data Active account data — kept for the life of your subscription. Completion records and certificates — minimum of seven (7) years after the subscription ends, to satisfy OSHA-style audit retention. Purchase and tax records — minimum of seven (7) years, as required by U.S. tax law. Support tickets — two (2) years from the date of last contact. Marketing preferences — until you withdraw consent. Zoom recordings — typically 90 days unless required for audit or learner makeup access. 12How we protect your data We implement industry-standard technical and organizational safeguards, including: Encryption in transit (TLS 1.3) and at rest (AES-256). Least-privilege access controls and quarterly access reviews. Multi-factor authentication for administrative accounts. Annual independent penetration testing and continuous vulnerability scanning. Secure data center hosting with SOC 2 Type II controls. Incident response procedures and breach notification within timelines required by law. No system is perfectly secure; we will notify affected users and regulators of any qualifying breach in accordance with applicable law. 13Your rights & choices Depending on your location, you may have the following rights: Access — request a copy of the personal data we hold about you. Correction — fix anything that is inaccurate or incomplete. Deletion — ask us to erase your data, subject to legal retention obligations. Portability — receive your learning records in a machine-readable format. Objection / opt-out — opt out of marketing or non-essential analytics at any time. Withdraw consent — where processing is based on consent, withdraw it without affecting prior lawful processing. Lodge a complaint — with your local data protection authority. We respond to verified requests within 30 days. There is no charge for reasonable requests. 14California residents (CCPA / CPRA) If you are a California resident, you have the right to know what personal information we collect, to request deletion, to correct inaccurate information, to limit use of sensitive personal information, and to opt out of sale or sharing for cross-context behavioral advertising. You have the right to lodge a complaint with your local supervisory authority. We will respond to your data protection authority’s inquiry promptly. 16Children’s privacy The AHS platform is built for adult workplace learners. We do not knowingly collect personal information from children under 16. If you believe a child has provided us information without parental consent, please contact privacy@ehs-360.com and we will delete the information promptly. 17International data transfers AHS is based in the United States and may process your data on servers located in the U.S. or in regions where our sub-processors operate. Where personal data is transferred from regions with stricter data protection laws (such as the EU/UK), we rely on Standard Contractual Clauses, adequacy decisions, or equivalent safeguards. 18Changes to this policy We may update this Privacy Policy from time to time to reflect new features, regulatory requirements, or operational changes.
